Most of the forms you will need to get started are provided for free on the Landlord Forms page of this site. The forms should, in most cases, be posted on the tenant’s door rather than mailed. If you can not post the form yourself, or do not have someone who can post it for you, give us a call or send an e-mail. We can post the notice for you for $40.00
Eviction actions proceed quickly in Florida. In most cases, we can have the tenant out of the property within three weeks. Consequently, the fee for the eviction is payable in advance. Any unused portion of the fee will be refunded. The attorney fee is earned once the complaint for eviction is filed. No additional attorney’s fees are due unless attendance of a court hearing is required, which is billable by the hour.
Florida landlord-tenant law provides that the prevailing party is entitled to a judgment for their attorney’s fees and costs. We always file a money damages count as part of the eviction complaint and issue combination summonses in Dade and Broward Counties. Palm Beach County insists on separate summonses for the possession and damages counts. Note that each summons issued costs $40.
In order to start the law suit for eviction we need a copy of your lease (if there is one) a copy of the notice, and full payment. We accept checks or paypal.
